I was served in the hospital parking garage, four hours after my mother died. He’d been waiting. That’s the only way it works—somebody has to be sitting in a car watching the elevator. My brother filed to freeze the estate accounts. Same accounts I’d been paying her nursing home out of since 2021. The freeze meant her final bill wouldn’t get paid. He knew that. His lawyer knew that. That was the point of the timing.
The nursing home called me two days later about eleven thousand dollars. I brought the court paperwork to the administrator and she read the whole thing standing up. Then she went and got a folder from her office. Inside was a payment agreement my mother had signed in 2021, naming me as the person authorized to make payments from the account. But that wasn’t what made her stop. There was another document in the folder, dated three months earlier, that changed everything.
It was a letter from my brother to the nursing home. He had contacted them himself and asked for a complete payment history. At the bottom, he had written that he understood I was handling every bill and that he had no objection to the arrangement. The administrator handed me a copy. His signature was on it. My attorney filed it with the payment records and asked the court to compare it with the emergency freeze request he had filed days later.
At the hearing, the judge asked my brother why he had described the accounts as being at risk when he had previously acknowledged in writing that I was paying our mother’s care from them. He said he had “changed his mind after her death.” Then the nursing home administrator produced one more document—the final invoice, along with a note showing my brother had called the facility the morning before he filed the freeze and asked what would happen if the estate account became inaccessible. The judge lifted the freeze long enough for the nursing home to be paid and ordered both sides to account for every estate transaction. My brother’s timing had created the exact record he was trying to avoid.
